Defense Attorney – Jay G. Wall
Cherokee County Georgia
Mental Illness Should Not Be a Crime
Across the United States, individuals living with serious mental illness are disproportionately represented in jails and prisons. Nearly 2 million arrests every year involve someone with a mental illness. Nationally, 37% of people in state and federal prisons and 44% of individuals in local jails have a history of mental illness. Many are incarcerated for non-violent, low-level offenses such as trespassing, shoplifting, or disorderly conduct, arising directly from untreated symptoms.

Criminal Defense for Mental Illness in Georgia
Jails and prisons have effectively become America’s largest mental health facilities—yet they are neither designed nor equipped to provide proper care.
Instead of treatment, many individuals are funneled into the criminal justice system, often due to:
- Zero tolerance” policing and nuisance laws
- Mandatory minimums for drug-related offenses
- Assumptions that mental illness equates to violence
- Lack of appropriate mental health crisis response systems

Legal Protections for Individuals with Mental Illness
Legal Protections for Individuals with Mental Illness
In Georgia, several legal strategies exist to protect those struggling with mental health conditions from unjust prosecution:
Mental Competency to Stand Trial
A defendant must be mentally competent to stand trial. If they cannot consult with their lawyer or understand court proceedings, the prosecution cannot continue. We coordinate evaluations with leading forensic psychologists and psychiatrists to determine competency and challenge it when appropriate.

Insanity Defense
Under Georgia law, a person may be found Not Guilty by Reason of Insanity if:
1. They were unable to distinguish right from wrong due to mental illness (OCGA §16-3-2),
or
2. They acted under a delusional compulsion that overpowered their will (OCGA §16-3-3).
If found not guilty by reason of insanity, the individual is placed in the custody of the Department of Behavioral Health and Developmental Disabilities (DBHDD) for treatment, not prison time.
Note: A “Guilty But Mentally Ill” verdict may sound like a compromise, but it results in the same prison sentence as a regular guilty plea—with no guarantee of treatment.
